Award of attorneys’ fees vacated

Where the district court concluded a woman’s Fair Housing Act claims were without foundation merely because she did not prevail at summary judgment, and awarded fees based upon that conclusion, it erred. While she may not have ultimately adduced evidence sufficient to survive summary judgment, the district court was not entitled to award attorneys’ fees on that basis.
